Charti - Terms of Use

1. AGREEMENT TO TERMS
- These Terms of Use constitute a legally binding agreement made between you and POCKETECH PTY LTD ("we," "us," or "our"), concerning your access to and use of the Charti mobile application. By accessing Charti, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use.
- IMPORTANT: IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. NO FINANCIAL ADVICE (HIGH-RISK WARNING)

3. AI ACCURACY & LIMITATIONS
- Our App utilizes advanced Artificial Intelligence (AI) to analyze charts. However:

AI Errors: AI models can produce inaccurate results ("hallucinations") or fail to recognize complex market conditions.

No Guarantee: We do not guarantee the accuracy, completeness, or timeliness of any analysis or signals provided.

Past Performance: Past performance of any trading strategy or AI analysis is not indicative of future results.
4. SUBSCRIPTIONS AND BILLING
- Charti offers premium features through auto-renewable subscriptions.

Billing: Payments will be charged to your Apple ID (App Store) or Google Account (Play Store) at the confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Management: You can manage or cancel your subscription in your App Store or Google Play account settings at any time. We use RevenueCat to manage subscription states securely.
5. REFUND POLICY
- All in-app purchases and subscriptions are handled directly by Apple and Google.

No Direct Refunds: POCKETECH PTY LTD cannot process refunds directly.

How to Request: If you wish to request a refund, please follow the official procedures provided by the Apple App Store or Google Play Store.
6. INTELLECTUAL PROPERTY RIGHTS
- Unless otherwise indicated, Charti and its source code, databases, functionality, software, and UI designs are our proprietary property. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes only.
7. USER DATA & PRIVACY
- Your use of Charti is also governed by our Privacy Policy. Please note that while chart images are stored locally on your device for your convenience, they are processed via encrypted channels for AI analysis.
8. LIMITATION OF LIABILITY
- To the maximum extent permitted by the laws of Australia, POCKETECH PTY LTD and its directors shall not be liable for any direct, indirect, consequential, or exemplary damages, including but not limited to loss of profits or data, arising from your use of the App.
9. GOVERNING LAW
- These Terms shall be governed by and defined following the laws of New South Wales, Australia (or the state where your company is registered). You irrevocably consent that the courts of Australia shall have exclusive jurisdiction to resolve any dispute.
